1. Acceptance of Terms

By visiting, browsing, or utilizing this portfolio website (https://moodyclouds.click) or commissioning creative design services from MoodyClouds ("the Studio"), you agree to abide by these Terms and Conditions.

2. Intellectual Property & Portfolio Showcasing

All creative works, animated stickers, illustrations, characters, logos, and website code presented on this website are protected by copyright, trademark, and intellectual property laws.

Unless explicitly licensed under a signed commercial commission agreement, no assets may be reproduced, redistributed, scraped, or repackaged into third-party sticker apps without express written consent.

3. Custom Commission Agreements

When you commission custom GIPHY sticker packs or graphic designs:

• Scope of Work: Defined in an individual statement of work (SOW) or invoice proposal.
• Revisions: Standard proposals include two (2) complimentary rounds of creative revisions during illustration and storyboard phases.
• Transfer of Rights: Upon full and final settlement of all agreed fees, the agreed commercial rights (exclusive or non-exclusive) transfer to the client.
• Portfolio Rights: The Studio retains the perpetual right to display commissioned artwork in our portfolio, case studies, and social media channels for self-promotional purposes.

4. GIPHY Channel Verification Disclaimer

While our sticker designs adhere to GIPHY's technical parameters (transparent backgrounds, 20% alpha ratios, looping metrics), GIPHY independently controls all profile verification decisions. Commissioning designs does not guarantee approval by GIPHY, as verification policies remain solely within GIPHY’s editorial discretion.

5. Limitation of Liability

This website and all creative previews are provided on an "as is" and "as available" basis without warranties of any kind. Under no circumstances will the Studio be liable for indirect, incidental, or consequential damages resulting from website downtime or third-party platform policy shifts.
